If South Dakota’s state lawmakers realized they would be laying waste to their state’s already rickety economy by tightening the smoking ban currently in place, they would never even consider such an action.
That’s the opinion of Deadwood, South Dakota tobacconists John and Vaughn Boyd. The husband and wife team own and operate the Deadwood Tobacco Company and Cigar Bar. They are members of the International Premium Cigar & Pipe Retailers Association that represents more than 2,000 small business owners, mostly mom-and-pop cigar store owners like the Boyds, and premium cigar manufacturers.
“There is no doubt that most of the two million tourists we get in Deadwood every year would find someplace else to go if they couldn’t smoke in our casinos,” said John Boyd. “We have some 1,300 residents in this town and most of them work in those casinos or in businesses that depend on them. All of these jobs would be at stake with any significant downturn in casino business as would tens of millions of dollars in state and federal payroll, and other tax revenues.”
Boyd pointed to North Sioux City casinos which have enjoyed increased business since Iowa adopted its smoking ban. Data released by the Bureau of Labor Statistics included in a report by the Federal Reserve Bank found statistically significant employment declines resulting from smoking bans, especially in bars and restaurants.
“The argument that a tighter smoking ban would better protect children from secondhand smoke is ludicrous because children aren’t even allowed in casinos, smoke shops and cigar bars,” said Boyd.
At the same time, Chris McCalla, legislative director of the IPCPR, questioned the quality of claims being made by anti-tobacco forces regarding secondhand smoke. McCalla said smoking bans such as South Dakota’s are usually based on false or misleading information about secondhand smoke.
“Read the Surgeon General’s report and not just the biased comments and summaries of the report and you will see that it is filled with what it calls ‘inconclusive evidence’ regarding secondhand smoke,” said McCalla.
“In fact, based on that report, the Occupational Safety and Health Administration established secondhand smoke standards well above the range which might be found in any bar or restaurant. And air quality testing conducted by the Oak Ridge National Laboratory confirms that levels of secondhand smoke in most bars and restaurants are well within limits established by OSHA,” he said.

Rep. Charlie Brown just doesn?t get it. Legislated smoking bans are not only unnecessary, they are an affront to the personal rights of smokers and non-smokers, alike, and they cost tax revenues and jobs and result in more failed businesses, says the International Premium Cigar & Pipe Retailers Association.
Brown keeps introducing bills like a current amendment to Senate Bill 175 that bans smoking in all public places except casinos and horse tracks. He has been voted down repeatedly in the past without serious consideration. This time, the bill ? complete with Brown?s amendment – is headed for debate in a conference committee hearing scheduled for next week.
Chris McCalla, legislative director for the IPCPR, called Brown ?misguided and misinformed.?
?Rep. Brown is wrong when he says there is a ?dire need? to protect Indiana?s citizens from secondhand smoke. Study after study exists that prove secondhand smoke is not harmful. Even the Occupational Safety and Health Administration says so. OSHA has established safe levels for secondhand smoke that are 25,000 times safer than air quality in most bars and restaurants,? said McCalla.
McCalla said it is the right of every business owner to declare their businesses smoke-free or not.
?It is not up to government to make that decision,? he declared. ?And customers can decide for themselves if they want to patronize a place that does or does not allow smoking on the premises. I think people are getting fed up with government telling them what they can and cannot do,? McCalla said.
In response to Brown?s claims that smoking bans do not hurt revenue at bars and restaurants, McCalla cited the Federal Reserve Bank in St. Louis regarding the proven negative effects on businesses from legislated smoking bans.
?The Fed has found that, based on impartial data generated by the Bureau of Labor Statistics, significant employment declines result from forced smoking bans, especially in bars and restaurants due to lost revenues,? he said.
McCalla also said a smoking ban that includes cigar stores, smoke shops and cigar bars would have a ruinous effect on those family-owned neighborhood businesses.
?Twenty-six percent of Hoosier adults smoke,? said McCalla. ?That may not be a majority of Indiana voters, but it?s more than enough to make a difference come election time. Legislators need to remember that.?

Alexandria sits in the geographic center of the state of Louisiana. City leaders passed a smoking ban in restaurants one year before the state did in 2007. Now some city officials are considering a total ban, a move that would eliminate the exemption of Alexandria?s bars and gaming establishments from the statewide ban.
?Statewide, the only places you cannot smoke are restaurants. For several years now, a small group of prohibitionists have consistently failed in their efforts to expand the state?s smoking ban to include bars. Although we are grateful that cigar shops and cigar bars are exempt from the state ban, the Alexandria proposal is simply a local attempt to get around the state?s defiant rejection of a more restrictive smoking ban,? said Chris McCalla, legislative director for the IPCPR.
McCalla said that legislated smoking bans are an affront to the rights of citizens and businesses alike.
?We fully support the right of individual business owners to choose to make their establishments smoke free or not. However, when the government steps in and tells them how to run their businesses, it has gone too far. That?s what legislated smoking bans do,? he said.
